In order to guarantee and protect the privacy and confidentiality of the personal data of the Users of our website and their own privacy, we have drawn up, in accordance with current legislation, this Privacy Policy.

DATA PROCESSING.

The personal data requested, where applicable, will consist of those data that are essential to identify and attend to the request of the data subject, resolve the issues raised and provide the contracted services, such data being collected for specific, explicit and legitimate purposes and not being processed in a way that is incompatible with the purposes indicated.

The owner of the data will be informed by AZUD, prior to the collection of its data, of the points established in this Privacy Policy, so that it can give express, precise and unequivocal consent to the processing of it.

DATA SOURCE.

Firstly, it is important for Users to be aware that when personal information is provided online (e.g. via e-mail or via the Internet), it can be collected and used by others. For this reason, AZUD accepts no responsibility for this information being collected, stored and/or processed by an unauthorised third party, as it has adopted the security measures available to it to ensure that this does not happen.

The data we process and store may originate from different places:

  • Through our website we collect personal data from those Users who voluntarily decide to complete the obligatory fields that we have included in each of the forms on our website.

Users will be responsible for the veracity and authenticity of the data they provide through our forms, being obliged to keep them updated to avoid errors on our part. Any false or inaccurate statement made as a result of the information and data provided through these forms shall be the responsibility of the User.

  • Information may also come through e-mails received at azud@azud.com, for which we inform Users that the e-mails sent are hosted on AZUD’s own servers, located within the European Union.

It should be noted that, if the User or potential customers so wishes, a meeting may be arranged by telephone, for which the User must provide their name and telephone number.

The purpose of the processing of all this data will be indicated at the time of collection and detailed in the section “Purposes of processing and storage periods” of this Privacy Policy.

LEGITIMACY FOR THE PROCESSING OF THE DATA.

The legal basis for the processing of Users’ data will depend on the time at which the personal data of the User, Potential Customer or Client is collected or processed:

  • Data collected through the Enquiry and information form: The data subject’s express consent (Art. 6.1 GDPR). These requests do not imply any contractual relationship.
  • Data collected through the form for sending newsletters: The data subject’s express consent (Art. 6.1 GDPR). When completing the aforementioned form, the data subject accepts the provisions of this Privacy Policy or specific clause.
  • Data collected through the Registration form for the contracting of products and services: The existing contractual relationship (Art. 6.2 GDPR). By completing the form, the data subject accepts the provisions of this Privacy Policy or specific clause.
  • Data collected through the Work with us form: The data subject’s express consent (Art. 6.1 GDPR).

These requests do not imply any contractual relationship. The CVs provided by Users allow us to create their corresponding profile and to take it into account for current or future recruitment processes. When completing the aforementioned form, the data subject accepts the provisions of this Privacy Policy or specific clause.

  • Data collected by e-mail: The express consent or the contractual relationship, depending on when the data are collected.

PURPOSES OF PROCESSING AND DATA RETENTION PERIODS.

The purposes for which each of the processing operations will be carried out by AZUD are established in the different informative clauses included in each of the data collection methods -web forms, etc.-.

In general, the data processing carried out by AZUD focuses on the following fields:

  • Accounting management: invoicing management.
  • Tax management: application of withholdings, allowances, etc.
  • Administrative management: logistics management, warehouse, deliveries, receipt of goods, etc.
  • Marketing: commercial actions and promotions about products or services aimed at our customers or Users who have requested information about them in the past, including the carrying out of satisfaction surveys.

Notwithstanding the above, we detail the processing together with the period of conservation of the data carried out by AZUD:

Contact form: To be able to contact the User to resolve the query, doubt or suggestion, in relation to the service provided or the interest expressed with respect to our organisation or our products/services. To provide both our Customers and potential Customers with offers and promotions of products and services of interest to them, invitations to our events and other content of interest.

This data will be stored on the e-mail provider’s server without any deletion period and for as long as the data subject does not express his or her objection. However, if the e-mails retained relate to the provision of services, they will be retained for the obligatory period stipulated in the contractual relationship. (5 years – Article 1964 of the Civil Code).

Newsletter form: This data will be used by AZUD to provide you with information and to contact you in relation to the interest expressed in receiving newsletters and advertising. These data shall be kept for as long as there is a mutual interest, provided that the data subject has not expressed his or her objection.

Data collected through Cookies: Through the Cookies that we inform you about in our Cookies Policy, which we recommend you read, and we collect data to personalise your experience and better meet your individual needs, improve our website, allow comments to be shared on social networks, etc. These data will be retained in accordance with the provisions of our Cookies Policy.

Work with us form: This data will be used by AZUD for the purpose of receiving CVs from people interested in working in our organisation. In case of participation in a selection process, such data will be used for the purpose of analysing the candidate’s professional profile. These data shall be kept for as long as there is a mutual interest, provided that the data subject has not expressed his or her objection. For further information, please refer to the “Receipt of CVs” section of this text.

OBLIGATION TO PROVIDE THE REQUESTED DATA.

To benefit the most from the services, Users must provide us with the information and personal data requested in our forms. If all the information requested and marked as compulsory is not provided, Azud will not be able to offer its services/products or send, where appropriate, the information requested and therefore the services/products in which the User is interested cannot be provided.

MINORS.

At AZUD we scrupulously comply with the requirements stipulated in the GDPR regarding data protection of minors, so we do not intentionally collect any information from children under 14 years of age (Article 7 LOPDGDD).

Furthermore, we inform Users that this website and the request and purchase of our products/services are only intended for persons over 18 years of age.

HOW WE PROTECT THE INFORMATION OF USERS, POTENTIAL CUSTOMERS OR CLIENTS.

AZUD implements physical, technical and organisational measures to maintain the security of personal data and to try to minimise the possibility of accidental or unlawful destruction, accidental loss, unauthorised use, alteration, unauthorised modification, disclosure and/or access, as well as any other unlawful form of processing of your data, in accordance with the provisions of Article 32 of the GDPR.

In this regard, and taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of the processing, as well as the risks of likelihood and severity that may affect the rights and freedoms of natural persons, appropriate measures have been put in place to ensure the level of security appropriate to the risk involved.

In any case, AZUD has sufficient mechanisms in place to:

  • Ensure the continued confidentiality, integrity, availability and resilience of processing systems and services.
  • Restore availability and access to personal data quickly, in the event of a physical or technical incident.
  • Regularly verify, evaluate and assess the effectiveness of the technical and organisational measures implemented to ensure the security of the processing.
  • Pseudonymise and encrypt personal data, where appropriate.

Notwithstanding the foregoing, as a User you acknowledge and accept that Internet security measures are not impregnable and that the networks used on the Internet are not 100% secure, so that any communication sent by this means may be intercepted and/or modified by unauthorised persons, whereby as a User you must also take extreme caution.

NOTICE OF PERSONAL DATA BREACHES OR SECURITY BREACHES.

A personal data breach involves a breach of security of information systems, which results or may result in the destruction, alteration, loss, unauthorised disclosure or access, accidental or otherwise, to personal data transmitted, stored or processed in connection with the provision of our services.

COMMUNICATION OF DATA TO THIRD PARTIES.

The personal data that Users or potential customers have provided to us through our website, or during the provision of services, will not be sold, transferred and/or exchanged with unauthorised third parties, except by legal obligation, or in the cases established below in relation to the international transfers of data that we carry out from AZUD.

On the other hand, for legal compliance, the data may be transferred to the Tax Administration and other Public Administration Bodies, when required.

Any person may exercise the rights of access, rectification, deletion, limitation of processing, the right to portability, the right not to be subject to automated processing, including profiling and the right to oppose the personal data contained in any of the files under the responsibility of AZUD, by requesting it by any means that leaves a record of its remittance and receipt, and clearly expressing their wishes, enclosing a copy of their ID card and any documents necessary to prove their identity.

What exactly can you apply for?

Right of access: You may request information as to whether we are processing your personal data.

Right of deletion: You may request the deletion of your personal data and AZUD must delete it without undue delay when:

  • The data are no longer necessary for the purposes for which they were collected or processed.
  • The data subject withdraws the consent on which the data processing is based, and there is no other legal basis for doing so.
  • The data subject objects to the processing on the grounds that it is for the purpose of direct marketing of products. The data have been processed illegally.

AZUD is present on Twitter, Facebook, Linkedin, and YouTube, without prejudice to the possibility of using others in the future.

It is for this reason that, through this Privacy Policy, AZUD recognises that it is responsible for the processing of the data published by it on these platforms, as well as the data that the Users send privately to AZUD for the purpose of being extracted, such as communications in order for it to deal with a query.

Notwithstanding the foregoing, through the profiles, AZUD does not share or communicate any personal information about Users, “followers” on Twitter, Facebook, etc.

We take advantage of this Privacy Policy to inform Users that AZUD’s profile on the aforementioned social networks is open to the general public, without limiting access to other users, so that our brand, services, products, promotions, etc. can be seen by as many people as possible. For this reason, in the event that Users who are followers of our profiles post information of a personal nature on our wall, it will be their sole responsibility.

Anyone who does not wish to be a “follower” of AZUD in the social networks in which it is present, simply has to stop following said profile following the provisions of the Privacy Policies and Terms and Conditions of the social network in question. Anyone interested in working with AZUD can send us their CV by registering as a User on our web platform, sending us their CV and applying for the job offers published.

In these cases, the data will be processed for the purpose of analysing the candidate’s professional profile and being able to give them the possibility of participating in personnel selection processes organised by AZUD, depending on vacant or newly created positions. Likewise, and in the event that the candidate’s profile is selected, their data may be used to process their incorporation into the AZUD workforce.

Similarly, at AZUD we process the information you provide us with the aim of having a database of future candidates to cover possible vacancies in jobs in our company, adjusted to your professional profile.
